- STAY CALM. This is very important; you need to keep a clear head to get all the facts straight. Call 911 immediately to report the accident and be sure to tell the operator if anyone is injured. In Florida, you are required to have a Traffic Report completed if the accident results in death, injury, or damage to property of at least $500.00.
- MOVE YOUR VEHICLE. If your vehicle is a hazard for other vehicles, move it out of the way if it is safe to do so.
- AVOID FURTHER INJURY. Turn off the ignition of your vehicle and any other vehicle(s) involved. Don't move anyone that is injured unless they are in immediate danger and try to keep the injured warm. Stand away from the vehicles in case they are hit again.
- AVOID CONFRONTATION AT THE SCENE. Try to avoid getting into an argument with the driver that is a fault. It is best not to discuss how the accident happened, just fully cooperate with the police.
- EXCHANGE INFORMATION: You should exchange information with the other driver(s). You should gather their driver's license number, registration and insurance information.
- WITNESSES. Even if the other driver admits fault, it is a good idea to get names, addresses and phone numbers of as many witnesses as possible.
- SEEK MEDICAL ATTENTION. Even if you feel like you only have minor injuries, we recommend getting medical treatment just to make sure.
- TAKE PHOTOGRAPHS. We suggest keeping a disposable camera in your car, or if not, have someone can bring one to the scene. We recommend you take pictures of all vehicles involved and any bodily injuries you may have.
- PROTECT YOUR RIGHTS. Although you generally must provide reasonable cooperation with your own insurance company's investigation, the same is NOT true for the wrongdoer's insurance company. You are under no duty to give the other driver's insurance company any type of statement about the accident. You should consider consulting an attorney before giving a statement to ANYONE, even your own insurance company.
