Personal Injury Law: The Basics

For example, if the driver of a car is distracted and not paying attention to what they are doing, they are putting others on the road at risk of an accident.
  • As a result of the breach of the duty of care, you were injured. This element is all about showing that the actual cause of your injuries was the other person/party’s failure to uphold the duty of reasonable care. For example, if a distracted driver fails to stop at a red light and slams into your vehicle, causing an accident that leaves you injured, you can prove causation.
  • You sustained damages. Lastly, you must show that you suffered “damages,” or losses, as a result of your injuries/the accident. These damages can be financial—such as medical bills, lost wages, or future lost earnings—or they can be non-economic in nature, such as pain and suffering, emotional distress, or reduced quality of life.
