- The duty of reasonable care was breached. In most cases, this involves showing that the other person/party was negligent and, therefore, failed to uphold the duty of care they owed you. For example, if the driver of a car is distracted and not paying attention to what they are doing, they are putting others on the road at risk of an accident.
- As a result of the breach of the duty of care, you were injured. This element is all about showing that the actual cause of your injuries was the other person/party’s failure to uphold the duty of reasonable care. For example, if a distracted driver fails to stop at a red light and slams into your vehicle, causing an accident that leaves you injured, you can prove causation.
- You sustained damages. Lastly, you must show that you suffered “damages,” or losses, as a result of your injuries/the accident. These damages can be financial—such as medical bills, lost wages, or future lost earnings—or they can be non-economic in nature, such as pain and suffering, emotional distress, or reduced quality of life.

Additionally, demonstrating each of these elements often requires providing documentation and evidence of how the accident occurred, the severity of your injuries, the extent of your medical treatment, the value of your damages, and more.
