Fort Myers Personal Injury Lawyers

Choose a Legal Team You Can Trust

When another person, company, or entity acts negligently or wrongfully, and you are injured as a result, you have the right to take legal action. This is known as personal injury law, and it allows injured people the opportunity to recover compensation for unexpected—and unplanned-for—losses. These losses might be financial in nature; think, medical bills for treating injuries and lost wages for time taken off work to heal. They might also be more intangible losses, such as pain and suffering or the emotional distress that comes with knowing your life will never be the same.

All that being said, filing a personal injury claim is rarely an easy task. Before you even begin, you have to determine if your injury or the accident that caused it qualifies you to bring a claim. And, to make matters even more confusing, there are numerous different subcategories of personal injury—do you need to file a car accident claim and, if so, what type? Were you injured on someone else’s property or hurt by a defective product? These types of personal injury claims are different from motor vehicle accident claims.

After any type of accident or event leaves you injured, it’s incredibly valuable to sit down with an experienced attorney and discuss your legal options. At The Dellutri Law Group, PA, we offer completely free consultations to all potential clients. This allows you the chance to meet with an experienced attorney and learn more about your rights moving forward. From our Fort Myers office, we are able to assist injured individuals with a variety of personal injury matters.

We encourage you to reach out to us today! Give us a call at (800) 391-4337 or contact us online to schedule a free consultation with one of our personal injury lawyers in Fort Myers.

Personal Injury Law: The Basics

The first step in filing your claim—and recovering compensation for your losses—is determining whether you even have grounds to file a claim in the first place. Personal injury law is fairly specific in outlining who may file a claim.

In order to have grounds to bring a personal injury claim in the state of Florida, you must prove all of the following elements:

  • Another person or party owed you a duty of reasonable care. This means that they had a responsibility to prevent you from coming to harm (within reason). For example, the driver of a motor vehicle is required to follow traffic laws and drive safely without putting other motorists at risk.
  • The duty of reasonable care was breached. In most cases, this involves showing that the other person/party was negligent and, therefore, failed to uphold the duty of care they owed you. For example, if the driver of a car is distracted and not paying attention to what they are doing, they are putting others on the road at risk of an accident.
  • As a result of the breach of the duty of care, you were injured. This element is all about showing that the actual cause of your injuries was the other person/party’s failure to uphold the duty of reasonable care. For example, if a distracted driver fails to stop at a red light and slams into your vehicle, causing an accident that leaves you injured, you can prove causation.
  • You sustained damages. Lastly, you must show that you suffered “damages,” or losses, as a result of your injuries/the accident. These damages can be financial—such as medical bills, lost wages, or future lost earnings—or they can be non-economic in nature, such as pain and suffering, emotional distress, or reduced quality of life.

As you can see, proving a personal injury claim involves numerous steps. Additionally, demonstrating each of these elements often requires providing documentation and evidence of how the accident occurred, the severity of your injuries, the extent of your medical treatment, the value of your damages, and more. It is absolutely critical that you work with an experienced attorney who can help you navigate this process.
