Philips CPAP Machine Defect Attorneys in Florida

Philips Respironics (Philips) has been accused of selling unsafe continuous positive airway pressure (CPAP) machines, bi-level positive airway pressure (BiPAP) machines, and mechanical ventilators. According to the complaints and a recall from Philips that occurred in June 2021, polyester-based polyurethane (PE-PUR) foam used in the machines can break apart and cause the user to inhale chemicals that have been linked to very serious illnesses and, unfortunately, cancer. CPAP users who were injured by these defective products have taken action to demand justice and compensation for their undue suffering.

The Dellutri Law Group, PA in Florida is currently investigating the situation and hearing from people who fell ill or lost a loved one after using a defective Philips CPAP machine. Dozens of lawsuits have already been filed against Philips, including individual claims and class action lawsuits. Based on the details of your situation, you might be entitled compensation—and our Florida CPAP lawsuit attorneys can help.

Health Risks of Defective CPAP Machines

The polyurethane foam in the mouthpiece of the CPAP machines can break apart with regular use. As it crumbles into microscopic pieces, it can release carcinogenic chemicals called volatile organic compounds (VOCs), too. Both the chemicals and the pieces are inhaled by the user as they sleep. With continual use of the defective CPAP machine, the user can become severely exposed to unsafe substances and face a higher risk of serious illnesses.

Particulate exposure from defective CPAP machines has been linked to:

  • Chronic migraines
  • Asthma
  • Liver and kidney damage
  • Lung damage
  • Respiratory inflammation
  • Certain forms of cancer
  • Nausea
  • Vomiting

Why is Philips Liable for the Unsafe CPAP Machines?

Information about the Philips CPAP machine defects began to circulate significantly in early 2021. By April, the company had received a large number of consumer complaints about black debris clogging or marring the device's airways. Many of the same reports included complaints of serious illnesses and irritation.

Philips investigated the complaints and discovered that the foam was breaking apart with regular use. However, the manufacturer waited three months to issue a recall.

Philips Respironics could be liable for harm caused by the defective CPAP machines due to:

  • Strict product liability: It could be argued that Phillips Respironics can be held to strict product liability law, which requires product makers to only sell products that are reasonably safe when used as intended. If a product becomes unsafe, then the manufacturer can be liable for the harm it causes to consumers.
  • Corporate negligence: It can also be argued that Philips was negligent in how it handled the unsafe product and recall. Instead of taking immediate action upon realizing the foam was breaking apart and being inhaled by users, the company waited three months to do anything. In this amount of time, an uncounted number of consumers might have been seriously injured by the product.
