Basis for Exactech Implant Recall

The polyethylene liner used in the Exactech hip and knee replacement systems has been found to be defective. Problems with the liners allow oxygen to come into contact with the metal implants, which triggers a subtle and gradual oxidation process. After the device has been surgically implanted, it continues to oxidize, which wears down the implant and destroys nearby bone and soft tissues.

Upon confirming the source of the defects, Exactech found that essentially all its implants manufactured between 2014 and 2022 were likely affected. Countless reports and complaints from patients and surgeons further confirmed their suspicions, prompting a massive recall. Although Exactech has tried to recall the products before more harm is done to patients across the nation, it does not excuse the harm that has already happened due to their negligence.

Timeline of Exactech Lawsuits

A quick timeline of Exactech issues and lawsuits:

  • August 2021: Exactech recalls the polyethylene inserts and liners in many of its hip, knee, and ankle replacement products. Before issuing this recall, the company notified surgeons – and only surgeons – that it would likely stop using the plastic liners.
  • February 2022: Exactech expands its recall to include all knee and ankle arthroplasty polyethylene inserts. Approximately another 40,000 implants and components were affected by this widened recall.
  • October 2022: The Judicial Panel on Multidistrict Litigation (MDL) combines dozens of Exactech lawsuits into an MDL to expedite the litigation process.
  • February 2023: A federal judge approves all future Exactech lawsuits to be consolidated in the MDL, effectively allowing anyone who has been hurt by an Exactech implant to more easily join a plaintiff class.
