Basis for Exactech Implant Recall
The polyethylene liner used in the Exactech hip and knee replacement systems has been found to be defective. Problems with the liners allow oxygen to come into contact with the metal implants, which triggers a subtle and gradual oxidation process. After the device has been surgically implanted, it continues to oxidize, which wears down the implant and destroys nearby bone and soft tissues.
Upon confirming the source of the defects, Exactech found that essentially all its implants manufactured between 2014 and 2022 were likely affected. Countless reports and complaints from patients and surgeons further confirmed their suspicions, prompting a massive recall. Although Exactech has tried to recall the products before more harm is done to patients across the nation, it does not excuse the harm that has already happened due to their negligence.
Timeline of Exactech Lawsuits
At The Dellutri Law Group, PA, we have been following claims and news stories about Exactech's defective implants for years. Although another recall was started recently, this is not a completely new problem.
A quick timeline of Exactech issues and lawsuits:
- August 2021: Exactech recalls the polyethylene inserts and liners in many of its hip, knee, and ankle replacement products. Before issuing this recall, the company notified surgeons – and only surgeons – that it would likely stop using the plastic liners.
- February 2022: Exactech expands its recall to include all knee and ankle arthroplasty polyethylene inserts. Approximately another 40,000 implants and components were affected by this widened recall.
- October 2022: The Judicial Panel on Multidistrict Litigation (MDL) combines dozens of Exactech lawsuits into an MDL to expedite the litigation process.
- February 2023: A federal judge approves all future Exactech lawsuits to be consolidated in the MDL, effectively allowing anyone who has been hurt by an Exactech implant to more easily join a plaintiff class.

Our Exactech recall attorneys from The Dellutri Law Group have worked on catastrophic injury claims for years. You can trust your Exactech claim with us, no matter how severe or extensive your injuries.
Injuries and health complications linked to Exactech implant failures vary, such as:

- Bone degradation and fractures
- Irritating, grating noise when moving
Who is Eligible to File an Exactech Lawsuit?
Most people who have had an Exactech joint replacement device fail on them will have a valid claim. However, some people might be ineligible due to specific circumstances. We cannot guarantee that you have a valid claim or can join a plaintiff class against Exactech, but we can analyze your case to determine your eligibility for you.
You might be eligible to file an Exactech joint replacement lawsuit if:
- You have an Exactech hip, knee, or ankle replacement implant;
- You have suffered some sort of injury or complication related to the Exactech implant; and,
- You have undergone revision surgery, have scheduled one, or have been told by your doctor that you will need one.
Damages in an Exactech Lawsuit
You are likely wondering what your Exactech claim or lawsuit will be worth. Leave the damage calculations up to our firm, so you don’t have to worry about bills, receipts, losses, liability, etc. We are here to fight for every last penny owed to you, just as if we were fighting for our own rights.
Damages that can add to the value of your Exactech claim include:
- Costs of revision surgery
- Other medical treatment costs
- Future therapy and specialized care
- Pain and suffering
- Lost income and wages
- Miscellaneous financial losses
When considering the compensation that you could be owed to you, it is important to know if your case will be handled individually or as part of a class action lawsuit. Individual claims and those handled as part of a mass tort will have damages specific to your losses. However, class action damages are split among the plaintiff class, with lead plaintiffs receiving more than other plaintiffs. Your individual losses won’t be directly influential to the compensation amount, but the goal is still to get enough compensation so that the average plaintiff in the class is fairly compensated.
