Motorcycle Accidents

Florida Motorcycle Accident Attorneys

Injured in a Motorcycle Crash? We Can Help.

Our clients describe their motorcycles as sexy, a bit dangerous, part of their persona, therapeutic, and the list goes on. Florida is too beautiful a place to be stuck indoors, and there is no better way to see all that Florida has to offer than on the seat of a motorcycle with the sun and breeze in your face. Many towns even have “bike night” events to celebrate their riders. But, being a motorcyclist in the state of Florida certainly comes with its fair share of dangers.

If you were to do a Google search for “motorcycle accidents in FL,” you would find pages and pages of news stories. No Florida county is safe from this either—Ocala, Marion County, Orlando, Sarasota, Bradenton, Crystal Springs, Polk County, Jacksonville, and Tampa are all listed on that page-one search (at least from our office at the time we searched). We know if you kept looking, you’d find your own town or county.

If you were involved in a motorcycle accident and you believe someone else was at fault for the crash, you have the right to pursue legal action against that person or another at-fault party. That’s where we come in. At The Dellutri Law Group, PA, we have been helping injured individuals throughout Southwest Florida for 1998 and, while we draw on this experience when helping our motorcycle accident clients, we also realize that every case is different. That’s why we take the time to get to know you, your story, and your specific concerns. From there, we build a case tailored to your situation.

Helping Catastrophically Injured Motorcycle Accident Victims

When a motorcycle accident occurs, the results are often catastrophic. Unlike in a typical auto accident, the motorcyclist doesn’t have the protections that the driver of a car would have. There is no steel frame, no front or side airbags, no seatbelt. All they have are, hopefully, a helmet and protective clothing. As a result, motorcyclists are susceptible to catastrophic injuries, like spinal cord injuries, brain trauma, severe road rash, broken bones, and more.

No one wakes up, hops on their motorcycle, goes out for a ride, and expects to be in an accident. Still, even though motorcyclists may not expect to be involved in a crash, we know they are often diligent about keeping an eye out for danger. We have represented many motorcycle enthusiasts over the years, and they are alert and courteous driver. But sadly, years of driving experience, driving defensively, and abiding by all traffic laws is not always enough to protect you from another motorist.

Maybe you were hit by a distracted driver who was too busy texting to see you. Maybe you were struck by a drunk driver who made the inexcusable decision to get behind the wheel while intoxicated. However the accident occurred, if you were not at fault, you shouldn’t have to pay for the damages—it’s as simple as that.

What are Florida’s Motorcycle Helmet Laws?

Wearing a motorcycle helmet is a crucial part of safely riding a motorcycle. It can protect you from serious injuries, or even fatal ones. Unlike people in cars who have a lot more protection, motorcycle riders only have what they’re wearing to protect them in the event of an accident.

In Florida anyone under the age of 21 must wear a motorcycle helmet when riding a motorcycle. But, if you are 21 or older, you can ride without a helmet if you have at least $10,000 in medical benefits. All riders, regardless of age, are required to wear proper eye protection when riding on public roads.

Dellutri Moto GuideMotorcycle Injury Compensation

The only thing worse than being seriously injured in a motorcycle accident is to NOT get the compensation you deserve – or to find out later that you have been taken advantage of by an insurance company. Insurance claims adjusters KNOW all the tricks in the book. The companies they work for have had years of practice in diminishing, devaluing, and denying motorcycle insurance claims and wrongful death cases.

“I wanted to take a moment to thank Amanda for her guidance and representation during what has become a very difficult chapter in my life. I truly felt that she not only represented me in the utmost professional way, never missing a beat with returned phone calls or messages and jumping through all of the hoops that this case threw at her in spectacular fashion, but she did so with kindness and most of all, integrity. So much integrity, as a matter of fact, that she was instrumental in my decision to pursue my law degree. I had put it off for so many years, but Amanda demonstrated to me that despite the flaws in the legal system itself, that there are still decent, upstanding people who do everything that they can within legal guidelines to help their clients. It was inspiring. This accident has turned my life upside down, but Amanda always found a way to make me feel better... not an easy feat. Just ask her! So, thank you, Amanda, for doing what you do. You are an asset in every sense of the word to this profession and to the people that you serve.” - D.K.
