Who Can File a Wrongful Death Claim in Florida?

In Florida, as in other states, only certain people are allowed to file a wrongful death claim on behalf of their loved one. Unfortunately, although the loss of a family member or friend is no doubt a significant blow to anyone, only certain individuals are permitted to seek compensation for their losses. Additionally, only the personal representative of the loved one’s estate can actually file the claim. This person may be someone who was appointed to be the personal representative in the deceased’s will, or it may be someone appointed by the court if the person died without a will.

A wrongful death claim in Florida is filed by the personal representative on behalf of the following people:

  • The deceased’s surviving spouse or children
  • The deceased’s surviving parent(s) or guardian(s) (if the person who died was a minor)
  • Relatives, either blood-relations or adopted siblings, who were dependent on the deceased, either partially or entirely, for “services or support”
